What does gender equality need? Revisiting the formal and informal in feminist legal politics

Abstract This article explores the political conflict over reforming how sex and gender categories are used in British law, focusing on speculative legal proposal to ‘decertify’ gender. Three interconnected arguments advanced. First, diverging views decertification both about seek marshal competing perspectives value risks of formalization its undoing. Second, understanding these views, more generally, benefits from an account formal informal as movements (un)settling, (un)acknowledgement, system (un)intelligibility, (non‐)deference which remains irreducible presence or absence state law.
